By engaging with VividMemoirs via email or any affiliated services, you agree to be bound by these Terms of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree to these terms, you are prohibited from using the service. The materials, concepts, and methods used in the VividMemoirs process are protected by applicable copyright and trademark law. Any theft or suspected theft of language, concepts, or interview methods will be prosecuted to the fullest extent of the law.

 

2. Use License
Permission is granted to the individual purchaser to engage with the VividMemoirs process, including responding to interview prompts and receiving a written or audio-based narrative. This is the grant of a limited license, not a transfer of title, and under this license you may not:

  • Modify, copy, distribute, or share VividMemoirs’ proprietary questions, prompts, or other intellectual property;

  • Attempt to reproduce or adapt the methodology for personal, commercial, or competitive use;

  • Remove any copyright or proprietary markings from VividMemoirs materials;

  • This license shall automatically terminate if you violate any of these restrictions and may be terminated by VividMemoirs at any time.

 

3. Limitations
In no event shall VividMemoirs be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the service. Because some jurisdictions do not allow limitations on implied warranties or liability for consequential or incidental damages, these limitations may not apply to you.

 

4. Revisions and Errata
The content and process of VividMemoirs may include technical, typographical, or conceptual changes or improvements. VividMemoirs reserves the right to update or revise any part of the process or its materials at any time without notice.

 

5. Links
VividMemoirs may include links to third-party services or platforms (such as VideoAsk or Dropbox). These are provided for convenience and user experience. VividMemoirs is not responsible for the content, privacy practices, or terms of these external platforms.

 

6. Terms of Use Modifications
VividMemoirs may revise these Terms of Use at any time without notice. By continuing to use the service, you are agreeing to be bound by the then-current version of the Terms.

 

7. Governing Law
Any claim relating to VividMemoirs shall be governed by the laws of the State of Maryland, without regard to its conflict of law provisions.

 

8. Refund Policy
We offer a 14-day money-back guarantee, provided the client has not completed the interview process. Once interview responses have been submitted and narrative processing has begun, no refunds will be issued.
